1. Organizer
1.1. The terms and conditions outlined herein are applicable to raffles or competitions (the “Competition”) organized by Maurten AB, a company registered in Sweden, with its registered office at Gibraltargatan 1a, Gothenburg 411 32, Sweden.
1.2. By entering a Competition, participants agree to be bound by these terms and conditions.
2. Participation requirements
2.1. The Competition is open to individuals who meet the minimum age requirement and residency criteria specified in the detailed terms of each individual competition. These requirements, including eligible locations and age limits, may vary depending on the specific competition rules.
2.2. When stated in the terms applicable to that specific Competition, Maurten Membership or purchases from Maurten is necessary to enter the Competition.
2.3. Employees, officers, and directors of Maurten, its affiliates, and subsidiaries are not eligible to participate in a Competition.
2.4. It is possible to withdraw from a Competition at any given time by given Mauren notice hereof to the email address stated at the bottom of these terms and conditions.
3. Disqualification
3.1. Participants may be disqualified for providing false personal details, tampering with contest mechanisms, using multiple accounts, or using systems to enter the competition more than the allowed number of times as set by Maurten. Offensive, discriminatory, and inappropriate comments that violate the rights of third parties will not be tolerated and will not be allowed to enter the prize draws.
4. Prizes
4.1. The winner(s) will receive the prize specified in the detailed terms applicable to that specific Competition.
4.2 All prizes are personal to the winner and is non-negotiable, non-transferable, and non-refundable. It cannot be redeemed for cash or any other form of compensation. Where a prize becomes unavailable for any reason, Maurten reserves the right to substitute that prize for a prize of equal value.
4.3. Winnings from Maurten Competitions may be subject to income tax for the winner. The winner is responsible for any and all taxes and fees associated with the prize and/or its use (if applicable). Potential tax implications for the winner will depend on the applicable laws and regulations at the winner’s country of residence, and it is the winner’s obligation to assess if they are responsible for any and all taxes and fees associated with the prize. We advise consulting local tax authorities to accurately assess any potential tax obligations.
5. Application process
5.1. To be eligible for winning, participants must meet the conditions specified for each Competition. The conditions or criterions for the Competition may vary from time-to-time and it is important to carefully read the instructions given at each time.
5.2 Entries must be received by the deadline date and time stated in the terms applicable to that particular Competition. Late entries will not be accepted nor reviewed.
6. Election of winners
6.1. The number of winners for each Competition will be specified in the detailed terms applicable to that particular Competition.
6.2. The winner(s) will be selected through a process determined by the specific Competition, which may include random draw, evaluation by a panel of judges, or assessment based on predefined criteria. The winners will be announced on the date and time specified for each Competition.
6.3. Notification to the winner(s) will be made via the contact method provided (such as email or phone) within a set number of days following the Competition’s closing date. If a winner cannot be reached within a reasonable time from the initial contact attempt,or fails to claim the prize within one (1) week from the award notification was sent, Maurten reserves the right to select and announce an alternative winner.
7. Processing of personal data
7.1. When you participate in a Competition organized by Maurten, we process your personal data. The data will be processed for the purposes of administering the Competition and contacting the winner(s). The processing is based on our legitimate interest in carrying out the Competition in an appropriate and effective manner. The personal data we may process includes your name, email address, phone number, location and/or residency, age, membership information, and any personal details you choose to provide (such as for example training goals or competition routines). If you are selected as a winner, we may also process your name, image, and additional information in connection with interviews and marketing activities, in accordance with the specific competition terms.
7.2. This processing is based on the performance of a contract, in order to deliver your prize and manage our relationship with you in accordance with the competition terms. When accepting the prize via the acceptance form, you also consent to Maurten using your name and image for marketing purposes, in accordance with the Swedish Act on Names and Pictures in Advertising (Sw. Lag (1978:800) om namn och bild i reklam).
7.3. We process and retain your personal data as needed to administer the Competition, contact the winner(s), deliver any prize, and manage our relationship with the winner(s) in accordance with the competition terms, after which the processing for these given purposes will cease. 8. Governing Law
8.1. All matters arising out of or relating to these terms and conditions are governed by and construed in accordance with the laws of Sweden, notwithstanding your domicile, residency or physical location, and without giving effect to any choice or conflict of law provision or rule that would cause the application of the laws of any other jurisdiction.
8.2. In the event of a dispute between Maurten and the participant, Maurten strive to comply with the local laws and regulations applicable at the participants location. Notwithstanding the foregoing, nothing in these terms and conditions shall be deemed to limit or exclude any mandatory consumer protection laws applicable in the participants country of residence, and such laws shall always prevail to the extent they provide the participant with greater protection than the laws of Sweden.
8.3 As a consumer, participants are always entitled to get the dispute tried in a competent court. The alternative dispute resolutions that may be relevant for a participant are:
- if you are located in Sweden, you can contact The National Board for Consumer Disputes (ARN), Box 174, 101 23 Stockholm, Sweden or www.arn.se;
- if you are living in the European Union, you can use European Commission’s Online Dispute Resolution to find the relevant body for you.
- if you are located outside of Europe, but not within the US or Canada, you can use the online dispute resolution stated above or contact your local authorities.
8.4 Maurten always strive to settle disputes that arise, but Maurten are however not obliged to act in accordance with any judgement of an alternative dispute resolution.
